In a decision released today, the United States District Court for the Southern District of New York upheld the constitutionality of New York City’s calorie-posting requirement for certain restaurants. The Court ruled that the federal Nutrition Labeling and Education Act of 1990 does not pre-empt the city’s regulation, and it held that the posting requirement does not violate the free speech rights of New York State Restaurant Association members.
